  1. Aplicabilidade e efetividade dos direitos fundamentais: ponto de vista.G. A. Calgaro - 2008 - Revista Mestrado Em Direito 8 (1):167-190.
This work is about current theories concerning the application of the constitutional rules, on the approach of the efficacy and effectiveness of the fundamental rights. It also suggests an alternative way of logical analysis of the problem, mainly taking in account the phenomena of the application-efficacy-effectiveness of the rules. Therefore, it discusses the dogmatic rules and proposes the logical separation between its applicability and its effectiveness, considering the effectiveness as the potential power to realize the fundamental rights.

Esbozo para una perspectiva integral sobre la ética en el contexto del determinismo tecnológico.G. A. Flórez Vega - 2024 - Trilogía 16 (33):e3128.

The COVID-19 pandemic revealed numerous weaknesses in pandemic preparedness and response, including underfunding, inadequate surveillance, and inequitable distribution of countermeasures. To overcome these weaknesses for future pandemics, WHO released a zero draft of a pandemic treaty in February, 2023, and subsequently a revised bureau's text in May, 2023. COVID-19 made clear that pandemic prevention, preparedness, and response reflect choices and value judgements. These decisions are therefore not a purely scientific or technical exercise, but are fundamentally grounded in ethics. The latest (...)

Through the lens of feminist speech act theory, this paper argues that artificial intelligence romance systems objectify and subordinate nonvirtual women. AI romance systems treat their users as consumers, offering them relational invulnerability and control over their (usually feminized) digital romantic partner. This paper argues that, though the output of AI chatbots may not generally constitute speech, the framework offered by an AI romance system communicates an unjust perspective on intimate relationships. Through normalizing controlling one’s intimate partner, these systems operate (...)

Within the philosophy of language, contextualists typically hold (and semantic minimalists deny) that pragmatic elements of an utterance can affect its semantic content. This paper concretizes this debate by analogizing both positions to different kinds of time-travel stories: contextualism is akin to Ludovician narratives that deny the possibility of temporal editing (or “the changing of past events”) while semantic minimalism is aligned with stories that allow the past to be literally altered. By focusing particularly on Denis Villeneuve’s 2016 film Arrival, (...)

In 1906, Henry Stephens Salt published a short collection of essays that presented several rhetorically powerful, if formally deficient arguments for the vegetarian position. By interpreting Salt as a moral sentimentalist with ties to Aristotelian virtue ethics, I propose that his aesthetic argument deserves contemporary consideration. First, I connect ethics and aesthetics with the Greek concepts of kalon and kalokagathia that depend equally on beauty and morality before presenting Salt’s assertion: slaughterhouses are disgusting, therefore they should not be promoted. Bernard Williams argues that human mortality is a good thing because living forever would necessarily be intolerably boring. His argument is often attacked for unfoundedly proposing asymmetrical requirements on the desirability of living for mortal and immortal lives. My first aim in this paper is to advance a new interpretation of Williams' argument that avoids these objections, drawing in part on some of his other writings to contextualize it. My second aim is to show how even the best version of (...)

It is commonly assumed that personalization technologies used by Google for the purpose of tailoring search results for individual users create filter bubbles, which reinforce users’ political views. Surprisingly, empirical evidence for a personalization-induced filter bubble has not been forthcoming. Here, we investigate whether filter bubbles may result instead from a searcher’s choice of search queries. In the first experiment, participants rated the left-right leaning of 48 queries (search strings), 6 for each of 8 topics (abortion, benefits, climate change, sex (...)

Although Disney films are sometimes denigrated as popular or “low” art forms, this article argues that they often engage deeply with, and thereby communicate, significant moral truths. The capitalistic enterprise of contemporary modern cinema demands that cinematic moral pedagogy be sublimated into non-partisan forms, often by substituting secular proxies for otherwise divine or spiritual components. By adapting Søren Kierkegaard’s tripartite existential anthropology of the self, I analyze the subjective experiences of the protagonists in three recent animated fairy tales—Disney’s Frozen, Moana, (...)

The paper proposes an anthropocentric argument for veganism based on a speciesistic premise that most carnists likely affirm: human flourishing should be promoted. I highlight four areas of human suffering promoted by a carnistic diet: (1) health dangers to workers (both physical and psychological), (2) economic dangers to workers, (3) physical dangers to communities around slaughterhouses, and (4) environmental dangers to communities-at-large. Consequently, one could ignore the well-being of non-human animals and nevertheless recognize significant moral failings in the current standard (...)

I argue that a comprehensive ontological assessment of the beatific vision suggests that an individual’s experience of God’s face is not merely dependent on a revelation of the divine energies, but that it requires a particular mode of reception on the part of the blessed individual grounded in the reality of their faith; lacking faith, what would otherwise be experienced as the blessed vision of God is instead received as a torturous punishment. Therefore, I contend that the beatific vision is (...)

Much recent academic literature on the afterlife has been focused on the justice of eternity and whether a good God could allow a person to experience eternal suffering in Hell. Two primary escapes are typically suggested to justify never-ending punishment for sinners: the traditional view focuses the blame for an individual’s condemnation away from God onto the sinner’s freely chosen actions; the universalist position denies the eternality of the punishment on the grounds that God’s inescapable love and eventual victory over (...)

In this paper we focus our attention on tableau methods for propositional interval temporal logics. However, while various tableau methods have been developed for linear and branching time point-based temporal logics, not much work has been done on tableau methods for interval-based ones. This chapter summarizes Augustine’s often-neglected aesthetic theodicy that balances his metaphysical definitions of evil and human agency against the ultimately beautiful story Augustine sees God, as the author of all Creation, writing. First, Augustine’s neo-Platonic conception of evil as the “privation of goodness” is explained which effectively eliminates much of the apparent evil in the world under the guise of a preeminent God’s loving care of the Creation which He fashions as good, but is later corrupted. Secondly, Augustine’s conception of (...)

This paper assesses the aesthetic components of the experience of forgiveness to develop a procedural model of the phenomenological process that negotiates cognitive judgments and understanding with emotional affective states. By bringing the Greek concepts of kalokagathia and eudaimonia into conversation with Ricoeur’s “solicitude,” I suggest that the impetus for engaging in the process of forgiveness is best understood narratively as the pursuit of a life well lived (in terms of beauty). In this chapter, the embodied consciousness of clubbing and raving is considered through the theory of extended mind, according to which the mind is a distributed system where brain, body, and environment play equal parts. Building on the idea of music as affective atmosphere, a case is made for considering the vibe of a dance party as cognitively, socially, and affectively distributed. The chapter suggests that participating in the vibe affords primary musical consciousness—a kind of pre-reflexive state characterized by affective (...)

  40. G.A. Cohen and the Logic of Egalitarian Congruence.David Rondel - 2012 - Socialist Studies 8 (1):82-100.
In this article, I argue that G. A. Cohen’s defense of the feminist slogan, “The personal is political”, his argument against Rawls’s restriction of principles of justice to the basic structure of society, depends for its intelligibility on the ability to distinguish—with reasonable but perhaps not perfect precision—between those situations in which what Nancy Rosenblum has called “the logic of congruence” is validly invoked and those in which it is not. More importantly, I suggest that the philosophical shape of Cohen’s (...)

Cardiotocography data uncertainty is a critical task for the classification in biomedical field. Constructing good and efficient classifier via machine learning algorithms is necessary to help doctors in diagnosing the state of fetus heart rate. *e proposed neutrosophic diagnostic system is an Interval Neutrosophic Rough Neural Network framework based on the backpropagation algorithm. It benefits from the advantages of neutrosophic set theory not only to improve the performance of rough neural networks but also to achieve a better performance than the (...)

Shortages of new therapeutics to treat coronavirus disease (COVID-19) have forced clinicians, public health officials, and health systems to grapple with difficult questions about how to fairly allocate potentially life-saving treatments when there are not enough for all patients in need (1). Shortages have occurred with remdesivir, tocilizumab, monoclonal antibodies, and the oral antiviral Paxlovid (2) -/- Ensuring equitable allocation is especially important in light of the disproportionate burden experienced during the COVID-19 pandemic by disadvantaged groups, including Black, Hispanic/Latino and (...)

Philosophy as a "Critical Theoresis".G. Avellino - unknown
-- 04.08.2024 -- Intervention held at the XXV World Congress of Philosophy in Rome, Italy -- The aim of this paper is to propose an interpretation of philosophy’s tasks as those of a “critical theoresis”. The formula draws from both Plato’s utilisation of the word ϑεώρησις and Herodotus’ particular use of the verb κρίνω. While the former indicates a cultural dimension that in itself implies an active participation of subjects in the objective social world, the latter expresses an hermeneutical principle (...)

G.A. Cohen attempts to provide a case for socialism that takes into consideration the reasons why socialism is desirable and some of the problems for its feasibility. He finds that the kind of community sentiment that socialism requires is possible, but the devices of social organization that can facilitate the growth of socialist sentiment along with the effective transmission of information are not currently known. In short, Cohen thinks social scientists and philosophers need to find out how to harness the (...)

If a problem is the collision between a system and a fact, Spinozism and German idealism’s greatest problem is the corpse. Life’s end is problematic for the denial of death’s qualitative difference from life and the affirmation of nature’s infinite purposiveness. In particular, German idealism exemplifies immortalism – the view that life is the unconditioned condition of all experience, including death. If idealism cannot explain the corpse, death is not grounded on life, which invites mortalism – the view that death (...)
